Welcome to Mandea Art! In these Terms of Service, “Mandea Art,” “we,” “us,” and “our” refer to the business Mandea Art, based in Vienna, Austria. “You” and “your” refer to any customer or visitor of our website and services.
Mandea Art operates this store and website, including all related information, content, features, tools, artworks, and services in order to provide you with a curated shopping experience (the “Services”). Mandea Art is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (these “Terms”), describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including browsing our gallery or purchasing any artworks, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent that all the information you provide is correct, current, and complete.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR ARTWORKS
Mandea Art offers:
* Original Paintings: one-of-a-kind artworks, hand-painted and signed by Ahmed Mande, each with a certificate of authenticity.
* Canvas Prints: high-quality reproductions of original paintings (future offering).
We make every effort to provide accurate representations of our artworks. However, colors and appearance may differ depending on your device settings.
We do not guarantee that the appearance or quality of artworks will meet your expectations. All descriptions are subject to change without notice. We reserve the right to discontinue any artwork at any time.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Mandea Art reserves the right to accept or decline your order at our discretion. Your order is accepted once we confirm it and receive your payment.
Please review your order carefully before submitting, as cancellation requests may not be accommodated once accepted.
Your purchases are subject to our Refund & Returns Policy:
* Original paintings: no returns (custom artwork exemption under EU law).
* Canvas prints: 14-day return period (EU consumer rights).
* Returns accepted only if the artwork arrives damaged. Customer pays return shipping unless the item is damaged.
SECTION 4 - PRICES AND BILLING
* All prices are listed in EUR (€).
* Prices include Austrian VAT, where applicable.
* Payment is accepted via Shopify Payments (credit cards, PayPal).
* Prices do not include shipping outside Austria.
You agree to provide current and accurate purchase and payment information.
SECTION 5 - SHIPPING AND DELIVERY
* Austria: Free shipping.
* EU countries: €12–35 (depending on artwork size).
* International: €17–65 (depending on artwork size).
All artworks are professionally packaged for safe delivery. Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you once artworks are handed over to the carrier.
SECTION 6 - INTELLECTUAL PROPERTY
All Services, including but not limited to text, images, graphics, artwork, logos, and website design, are owned by Mandea Art and protected by Austrian and international copyright and trademark laws.
You may use the Services for personal, non-commercial purposes only. Unauthorized use is prohibited.
SECTION 7 - OPTIONAL TOOLS
You may be provided access to third-party tools via Shopify. These are provided “as is” and “as available” without warranties. Use at your own risk.
SECTION 8 - THIRD-PARTY LINKS
Our Services may contain links to third-party websites. We are not responsible for their content, accuracy, or practices. Please review their policies before engaging in any transaction.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Mandea Art is powered by Shopify, which enables us to provide the Services. However, sales are made directly with Mandea Art. Shopify is not responsible for your purchases or transactions.
SECTION 10 - PRIVACY POLICY
All personal information is handled in compliance with GDPR and our Privacy Policy. Shopify may also process your information as outlined in Shopify’s Privacy Policy.
SECTION 11 - FEEDBACK
If you provide feedback, suggestions, or reviews, you grant us the right to use it without compensation.
